Discrimination against any disabled persons in the connection with employment is covered by the Equality Act 2010 This act makes it unlawful for employers to discriminate against disabled people in the areas of recruitment, promotion and training or dismissal and applies to all employers.
Compensation for Disability Discrimination is unlimited. The average settlement in 2008/09 was over £52,000. Disability is defined as "a physical or mental impairment which has a substantial and long-term adverse effect on the individual's ability to carry out normal day to day activities".
The Equality Act extends protection to cover discrimination "arising from" a disability (unless this can be justified). Employers can no longer ask certain questions about a job applicant’s health before making a job offer with some specified exceptions
